DENIED PART B CANCER CLAIMS FROM ROCKY FLATS, SANTA SUSANA AREA IV, AND DESOTO FACILITIES CAN BE REOPENED
The National Institute of Occupational Safety and Health (NIOSH) published complete rewrites of the technical documents the use to reconstruct dose for Rocky Flats, Santa Susana Area IV, and De Soto facilities.
For the Rocky Flats Plant, NIOSH rewrote the documents for internal and environmental exposure.
For the Santa Susana Area IV and De Soto facilities, NIOSH rewrote the document for Internal Co-Exposure Dosimetry Data.
The Department of Labor allows claimants to ask that their claim be reopened after a Final Decision was issued to deny if NIOSH identifies either a change in the Probability of Causation guidelines or a change in the dose reconstruction methods.
The request to reopen the claim must be made in writing and must show that the reason for the request is that NIOSH changed its guidelines and dose reconstruction methods.
966 Rocky Flats claimants potentially are eligible to have their case reopened. Santa Susana Area IV has 115 claims denied and De Soto facility has 119 denied claimants.
